Best Speaker Award on 30th June 2011

Dear Friends,
It was a day when i have delivered my Project 5 and got best Speakers award. Along with me was a very good frined of mine Sandeep Adnani who also was doing his P5 and a very senior Madam Toast Master Ms. Eileen Buckner who was doing her AP - Story telling.
The feeling to get the prize is like being on cloud seven.
Thanks to Toastmasters for whatever best it has given me to develop my personal orator skills.

Travel Mess ( Body Language ) - Project 5 - CC Manual


Enact like a traveller :

Jeans Tshirt sports Shoes and Lap top on the shoulder and a Trolley Bag. Start walking and talk on phone with sister.
Yes … Yes we are in Ahmedabad doing our luggage and will be there by 6:30 Morning at Sharjah airport. I checked the flight is on time. You bring the Pajero and listen anyone else is also coming. We have lots ot luggage. Ok Ahsan uncle is also coming … so everyone knows that Mom and Dad  are coming. Great we will have fun tomorrow. 
Mushi everyone is coming to welcome us on the airport.
Officer these are the passports.
Mrs Mushfeqa …. Yes My Wife …. Ok  this person cannot travel
What ???? But Why ????
The passport has expired….Officer said
What ??? Yes she cannot travel … passport expired.
Oh  my GOD !!!!!
How many of us in the room experienced to go back from Airport not because you didn’t get the seat but because your travel documents got messed up.
Thanks GOD I am not alone.
Toastmasters of the day, Fellow Toastmaster and distinguished guest.
In 2007 my complete family  both parents and Wife and son were in India due to some personal reason and I  used to travel quite frequently to India  almost every 2 months for 6/7 days. I used to only travel in Air Arabia as it was convienient and soft on my pocket. One day in March 2007 I have requested my parents to  come and stay with me in Dubai for 2 months in Summer Vacation of my Son. They agreed and I was so happy since we all are going to be together for complete 2 months in Dubai.
I have arranged for the Visa and return Ticket of them in Air Arabia.  Our flight was on my birthday 16th April 2007 at 04:45 AM. I have arranged a Taxi  from Baroda to Ahmedabad Airport which is 120 kms – 2 hrs car drive.
I have asked mother to take out the passport and show me. She has taken out the passport from cupboard given it to me , I have glanced at it and given it back to her and she kept it in the cupboard. I have asked her to put it back and carry it in her handbag.  She said “ Son, I will put it in the bag but first let me arrange the handbag.
The reason I didn’t keep the passports with me was because of 2 reason 1. I’m an absentminded guy and 2 . and real reason my passport pouch was big enough to carry my passport only.
In the evening I asked my mother to take out the passport and put it in the bag. She has taken the passport and put it in her bag which even I have seen.- YES . So here we go.
At 11:00 PM of 15th April we have started from Baroda to Ahmedabad airport.
We have reached Ahmedabad Airport by around 1:30 AM 16th April 2007. I have asked my father to wait in the Taxi till I do luggage formality and I arrange a wheel chair for both of them since both  parents were 70+ age.
After we  came to know my wife cannot travel, we have decided that let both the parents board the plane and we 3 will stay back – both me and my wife and Son. I have requested the Officer to issue only 2 boarding pass.
Officer : Your mother and father also cannot fly.
WHAT  ? Not again.
Couln’dnt believe my eyes. How can I go wrong?
I have started recollecting … how that has happened. And YES it just happen that my mom has kept the passport in the cupboard at right side and I have seen her taking the passport from the cupboard at left side.
I did’nt know how to react !!!!
My mother started crying, as she realized her mistake. She realized that she picked up a packet from the other drawer  of a cupboard.
The best part is the whole blame came on my poor father who was not even knowing what is happening inside. My mother started saying … its because him … he does not allow us to throw old things from the house…. And if we insist he says if Old has to be out … Throw me too…. So no discussions.
The only time I wished and prayed to GOD … please do something let this flight get delayed by minimum 6 hours. So I can get the correct passports from Baroda . But GOD’s wish was something else. The flight was on time.
We have decided not to start blaming game as that will only upset everyone. Whatever has to happened has happened.
Two things which I have learned –
1.   Check / Double check your travel documents.
2.  Keep and treasure Old documents – if it is very important but at a place where we don’t mess up.

 I am elated to use above exclamation! words to describe our club members performance in Area-7 contests last day (25/Feb/2011).
Without doubt, I can say that our club members were way ahead in both content and quality and may have raised the bar for area level competition standards. Those club members who were not able to make it for Area-7 contests, sorry to say that you all have missed a chance to watch a scintillating performance of following winners  from our club.
Please join me to congratulate them for their aspiration, dedication, hard work and performance to bring glory for our club as well as to inspire other club members to reach the stars!

Will your Nominee get the money on your death?
Did you think that your nominee is the person, who will get all the money legally from your Life Insurance Policy and Mutual funds investments? Ha! That is exactly what you’d think if you aren’t aware of the legal aspects. We assume a lot of things which sounds like they’re obvious, but are not true from the legal point of view. Today, we’ll concentrate on nominations in financial products.
For whom are we earning? For whom are we investing? Who, do we want to leave all our wealth to, in case something happens to us? It might be your children, your spouse, parents, siblings etc., or just a subset of these.
You also might want to exclude some people from your list of beneficiaries!. So you think you will nominate person X in your Insurance policy, and when you are dead and gone, all the money goes to person X and he/she becomes the sole owner? You’re wrong, dude ! It doesn’t work that way. Let’s see how it actually does!
What is a nominee?
According to law, a nominee is a trustee not the owner of the assets. In other words, he is only a caretaker of your assets. The nominee will only hold your money/asset as a trustee and will be legally bound to transfer it to the legal heirs. For most investments, a legal heir is entitled to the deceased’s assets. For instance, Section 39 of the Insurance Act says the appointed nominee will be paid, though he may not be the legal heir. The nominee, in turn, is supposed to hold the proceeds in trust and the legal heir can claim the money.
A legal heir will be the one whose is mentioned in the will. However, if a will is not made, then the legal heirs of the assets are decided according to the succession laws, where the structure is predefined on who gets how much. For example, if a man during his lifetime executes a will. In the will, he mentions his wife and children as legal heirs, then after his death, his wife and children are the legal owners of his assets. It is essential that one needs to execute a will. It is the ultimate source of truth and replaces the succession law. Nominee can also be one of the legal heirs.
Important :
Mention the Full Name, Address, age, relationship to yourself of the nominee. Do not write the nomination in favour of “wife” and “children” as a class. Give their specific names and particulars existing at that moment. If the nominee is a minor, appoint a person who is a major as an appointee giving his full name, age, address and relationship to the nominee.
Why is the concept of nominee?
So you might be wondering, if the nominee does not become the sole owner, why does such a concept of “nominee” exist at all? It’s pretty simple. When you die, you want to make sure that the Insurance company, Mutual fund or your shares should at least get out of the companies and go to someone you trust, and who can further help, in process of passing it to your legal heirs.
Otherwise, if a person dies and hasn’t nominated anyone, your legal heirs will have to go through the process of producing all kind of certificates like death certificates, proof of relation etc., not to mention that the whole process is really cumbersome! (For each legal entity! The insurance company, the mutual funds, for the shares, for the real estate..) . So, to simplify, if a nominee exists, these hassles don’t happen, since the company is bound to transfer all your money or assets to the nominee.The company then goes out of scene & then, it’s between nominee and legal heirs.
Example of Nomination
Ajay was 58 years old who died recently in an accident. As his children were settled, he wanted to make sure that his wife is the sole owner of all the monetary assets. This includes his insurance policy and mutual funds. So during his lifetime, he nominated his wife as a nominee in his term insurance policy and mutual funds investments. However, after Ajay’s death things didn’t turn up the way he wanted. The reason being Ajay did not leave a will. Though his wife was the nominee in all his movable assets,as per the law, his wife, along with children, were the legal heirs and all of them had equal right to Ajay’s assets. One simple step which could have saved the situation was that Ajay should have made a will which clearly stated that only his wife was entitled to get all the money and not his children.
IMPLICATIONS OF NOMINATION ARE DIFFERENT FOR EACH CATEGORY !!
Nomination in Life Insurance
A policyholder can appoint multiple nominees and can also specify their shares in the policy proceeds. Nomination in life insurance has one limitation, as insurance policies are bought to secure your financial dependents, your first choice of nominee has to be your family members. In case you want to nominate a non-family member like a friend or third party, you will have to show/PROVE the insurance company that there is some insurable interest for the person. This happens because of a Clause called PRINCIPAL OF INSURABLE INTEREST in insurance. Note that provision of nomination in life insurance is related to Section 39 of the Insurance Act. Note that as per LIC website, Nomination is a right conferred on the holder of a Policy of Life Assurance on his own life to appoint a person/s to receive policy moneys in the event of the policy becoming a claim by the assured’s death. The Nominee does not get any other benefit except to receive the policy moneys on the death of the Life Assured. A nomination may be changed or cancelled by the life assured whenever he likes without the consent of the Nominee. Make sure, you have a nominee for your policy for easy settlement of the claim, if you do not have any nominee mentioned in the policy, it can turn out to be a disaster for your dependents to get a claim.
Nomination in Mutual funds
In case of mutual funds, you can nominate up to three people, who can be registered at the time of purchasing the units. While filling in the application form, there is a provision to fill in the nomination details. Even a minor can be a nominee, provided the guardian is specified in the nomination form. You can also change nomination later by filling up a form which is available on the mutual fund company website. Nomination in mutual funds is at folio level and all units in the folio will be transferred to the nominee(s). If an investor makes a further investment in the same folio, the nomination is applicable to the new units also. A non-resident Indian can be a nominee, subject to the exchange control regulations in force from time to time.
Nomination in Shares / Stocks
Quiz for you . Now you know what a nominee means and who actually gets the money. So if there is a husband H, with wife W and nephew N, and he has nominated his nephew N to be the nominee of his shares in demat account, who will have the legal right to own the shares after husband’s death? If you answer is wife, you are wrong in this case! In case of stocks, it does not work the usual way, if a will does not exist.
In the verdict, Justice Roshan Dalvi struck down a petition filed by Harsha Nitin Kokate, who was seeking permission to sell some shares held by her late husband. The Court noted that as she was not the nominee, she had no ownership rights over the shares. Ms Kokate’s lawyer had argued that as she was the heir of her husband who had died intestate (without a will), she should have ownership rights of the shares, and be able to do anything with them as she wished. In this case, Ms Kokate’s husband had nominated his nephew in favour of the shares. Justice Dalvi however noted that under the provisions of the Companies Act and the
Depositories Act, Acts which govern the transfer of shares, the role of a nominee was different.“A reading of Section 109(A) of the Companies Act and 9.11 of the Depositories Act makes it abundantly clear that the intent of the nomination is to vest the property in the shares which includes the ownership rights thereunder in the nominee upon nomination validly made as per the procedure prescribed, as has been done in this case.” It means that if you have not written a will, anyone who has been nominated by you for your shares will be the ultimate owner of those stocks, The succession laws on inheritance will not be applicable but in case, you have made a will, that will be the source of truth.
Nomination in PPF
Let me give you some shock first. If you have Rs 10 lakh in your public provident fund (PPF) account and you have not nominated anyone for your PPF account, your legal heirs will get maximum of Rs1 lakh only! Yes, it’s so important to have a nominee, now you get it. You can nominate one or more persons as nominee in PPF. Form F can be used to change or cancel a nomination for PPF. Also note that you cannot nominate anyone if you open an account for a minor.
Nomination in Saving/Current/FD/RD Account in Banks
FD’s also come with nomination facility. While opening a new account, there is a column for nomination in the same form and you should fill it. You can nominate two persons with first and second option. Note that in case you have not done any nomination till now, you should request Form No DA-1 from your Bank which is used to assign a nominee in future. (Examples of ICICI Bank , HDFC Bank , Canara Bank) . In the same way to change/cancel the nomination you need to fill up Form no DA-2. Read about Corporate Fixed Deposits
As per a famous case, A Bench of Justices Aftab Alam and R M Lodha in an order said that the money lying deposited in the account of the original depositor should be distributed among the claimants in accordance with the Succession Act of the respective community and the nominee cannot claim any absolute right over it. Section 45ZA(2)(Banking Regulation Act) merely put the nominee in the shoes of the depositor after his death and clothes him with the exclusive right to receive the money lying in the account. It gives him all the rights of the depositors so far as the depositors’s account is concerned. But it by no stretch of imagination make the nominee the owner of the money lying.

The Humorous Contest Speech
It was that time of year 2011 in the Toastmaster's Calendar - Dubai Chapter for the humorous speech contest.
Who would enter?
Since i was travelling i didn't register for it and i went there just to attend it and do the other leadership role. Last moment one of the speaker dropped out and then one of the fellow toastmaster have motivated me to do the speech which i have done in Project 4 - "Absentmindedness"
I decided to take that challenge on the last minute - Imprompto Speech. I had never been in humorous speech contest despite having given humorous speeches before. It would be a challenge and i thought what maximum would happen would be i will not win any prize ... but atleast i have attempted it.
So i have given my nomination to be one of the contestant.
I chose a topic same as Absentmindedness and rehearsed it.
I started recollecting all the points which one of the evaluators has suggested me to take care of while we are giving the speech.
Now the time has come and i did to the best of my ability.

It was a time for the results and ...... surprisingly i got 1st Runner up award for the Humourous Speech Contest - Dubai Chapter.

I can never forget that day .... it was 10th January 2011.

Absent Mindedness - Project 4 - CC Manual

Everyone experiences absentmindedness from time to time, but I personally seem to be especially afflicted.
Have you ever walked into a room and forgotten why you walked in there? Have you ever forgotten to give someone a telephone message? Do you occasionally forget where you have put things or what you were planning to do? And if answer is Yes …. Let me give you a good news that you are not alone.
Toast Master of the Day … Fellow Toastmaster and welcome Guests … Good Evening.
Everyone experiences absentmindedness on a regular basis. Absentmindedness is caused by the failure to pay attention to what you need to do.
It is usually caused by one of two different scenarios.
1. The thing you need to do is part of a habit or routine such that it requires very little attention.
2. You are distracted by something that takes your attention away from the thing you need to do.
We do not have Balcony in our house my wife used to put the clothes out on the rope which we have tied across out from the Window. It just happened one Friday I was watching a TV and my wife had to go out somewhere.
She wanted me to dry the washed cloths . Normally I don’t do much of household work but on that day as a good husband I absentmindedly agreed to help her . While doing the job I was thinking also … what a wonderful invention in the form of washing machine has been done. The cloths are almost dry and we need to just put it for some time and its ready for iron and fold to keep in the wardrobe. Any way I have completed the job and was back watching TV.
Few hours later my wife came back and started shouting … Aadil I have given you small job and you are not helping me.
I said what happen Darling ??? I was thinking that she will praise me for my work.
She said the cloths are still in the washing machine. I was taken back with a surprise and started thinking that then what cloths I have put it on the rope to dry. I went in to the room to check personally on what my wife is saying.
She said … my absent minded husband , like rebaking a baked cake ,you have put once again the same clothes which were already dry and which I have just taken out from the rope before going out.
What else can she expect from my side.
Another case ….
In those days in India the place where I am staying … we used to trespass a compound for taking a shortcut to reach on a main road. The owners of the compound used to keep it closed and whenever we used to go on a scooter, we have to get down open the gate and pass by.
My cousin was having his board results and I said let me take you along with me on my scooter. On the whole route I have spoken to him for about 15 minutes giving him a pep talk and tried to keep him motivated. Don’t worry … the result will be good … Blah… Blah ……
Finally when I have parked my scooter in his school and what I saw is my cousin is not there on the scooter. where did he vanish…. I tried to remember that he was there till the time we opened the gate… in fact he only has opened the gate. Suddenly I realized that yes that time after he opened the gate and was trying to close it again .. I thought that he is sitting behind and I drove the scooter. I was also thinking that while I am talking to him in the whole journey and he is not responding because he might be nervous …. Others saw me as a lunatic in soliloquy.
One more absentmindedness incident ......A friend of mine called as Munaf and me were going to a class of Mathematics when we were in 12th.It just happened that a Munaf did'nt came for a few classes. One day while Munaf was not in the class and while we were doing our classwork ... my teacher Pradeep Pandya asked me suddenly ... Aadil ... Is Munaf SICK ... and i have replied absentmindedly ..... No Sir..... he is MUSLIM. Every on bursted in a laugh ... however i didn't even realize it that i have made an absentminded statement.
There has been no medical inventions which has happened to overcome Absentmindedness completely.
But a few suggestions would help you to overcome it to a great extent.
1. Try not to do 2 jobs at the same time
2. Along with Physical exercises ... do mental exercises also .. ie. working on mindteasers/ puzzles / crossword etc.
3. Keep your life disciplined and stick to some regime.
Friends … It is possible to completely overcome absentmindedness, absentmindedly
Oh .... Look i forgot .... i have to finish the project in the time limit !!!!!!!!!!!
